LETTER OF STUDENT GUARANTEE AGREEMENT

This Program Guarantee is provided by Lister Management as the First Party to Student as the Second Party who participate in the course programs including IELTS and TOEFL ( iBT and ITP) Test Preparation Program :

I. INTRODUCTION    

1.1 What is meant by the Program Guarantee in this agreement letter is that the Second Party is given guarantee to achieve the target or score or international test score with an increase if only the Second Party takes the test preparation program.  The target standard guarantee is adjusted to the class that followed (such as that mentioned on the web).   

The following are the standards of guarantee for each program.

IELTS:

Private:

  1. IELTS Ultimate Bronze (60 meetings ): 6.5
  2. IELTS Ultimate Silver (70 meetings ): 7
  3. IELTS Ultimate Gold (80 meetings ): 7.5

Group:

  1. IELTS Group Ultimate Bronze (60 meetings ): 6.5

TOEFL ITP:

Private:

  1. TOEFL ITP Ultimate Bronze (60 meetings ): 500
  2. TOEFL ITP Ultimate Silver (70 meetings ): 550
  3. TOEFL ITP Ultimate Gold (80 meetings ): 600

TOEFL iBT :

Private:

  1. TOEFL iBT Ultimate Bronze (60 meetings ): 79
  2. TOEFL iBT Ultimate Silver (70 meetings ): 96
  3. TOEFL iBT Ultimate Gold (80 meetings ): 102

1.2 If after attending 1 (one) level of the course program, the Second Party does not reach the score/grade mentioned above, the Second Party is entitled to claim the guarantee as described in Chapter III of this agreement letter.   

II. TERMS AND CONDITIONS OF THE APPLICABILITY OF THE GURANTEE    

2.1 The program guarantee is given to the second party participating in the program that has been selected.   

2.2 The First Party is required to pay full course fee as an administrative requirement at least 1 (one) month before the program starts. If payment has not been made, the First Party has the right to unilaterally cancel the class and the course fee that has been paid cannot be returned for any reason.   

2.3 The Second Party shall follow the learning process with active participation and discipline according to the schedule that has been agreed at the beginning of the class opening, with a minimum attendance rate of 90%.   

2.4 The Second Party is obliged to follow the International Test (IELTS or TOEFL) no later than 4 (four) weeks after the class has ended and submit a photocopy of the results of the International Test to the Customer Service team of the First Party.

2.5 The breach of the Clauses in Chapter II regarding the terms and conditions of this guarantee program will result in the invalidation of the guarantee from the First Party to the Second Party.   

III. FORMS AND PROCEDURES FOR GUARANTEE CLAIMS 

3.1 The Second Party shall submit  the latest progress test result or send a scanned copy of the IELTS test certificate to the Customer Service team of the First Party and fill out the re-registration form free of charge.   

3.2 Forms of Guarantee:   

3.2.1 Group          

Guarantee is given in the form of repeating the same class without having to pay, with the number of meetings 20% of the total previous class meetings.

For example : IELTS class 60 meetings, the guarantee which will be given:

60 x 20% = 12

Therefore, the class replacement (guarantee) is only 12 meetings.

Guarantee cannot be exchanged for any other programs, compensation , or refunds.

3.2.2 Private and Semi Private          

Guarantee is given in the form of a refund of 40% of the cost paid.

3.3 The guarantee is only valid  1 (one) time.   

3.4 The Second Party who is eligible for the program guarantee can attend the course /class program in accordance with the program the Second Party has taken. If within the period of 1 (one) month there is no group or group class, the Second Party is entitled to get a private class.

CLASS RULES AND REGULATIONS

I. Class Rules                      

Students are expected to be present on time.

1. Students are required to deactivate cell phones or other communication tools that are not used for learning, for it should not disturb the teaching and learning activities during the class.

2. If a student is unable to take the progress test due to health issues or other important matters, the student is given the opportunity to take the follow-up exam.

3. Students are expected to wear neat and polite clothes.

4. Students are not allowed to eat during the class. If a student has not had time to eat because of some matters, the student is given 15 minutes to eat before the class begins.

II. Delay      

1.Delay caused by student, will not be reimbursed for time.

2. Student’s delay in group class for more than 30 minutes is declared absent. As for the Private class, the will be canceled and will still be counted as a meeting.

3. If the student leaves the class early when the class is still in progress and the time remaining is more than 30 minutes, the student is declared absent.

 

IV. Class Cancellation and Schedule Change      

A. Group Class

1. The cancellation of the session upon the schedule that has been agreed by all students, must be made at least 1 (one) day before.

2.  If a session is canceled for less than 1 (one) day, then the session that cannot be followed will be declared forfeited (no replacement).

3. Replacement of class schedule can only be done 2 (two) times or sessions from the number of sessions taken without changing the overall schedule that has been agreed upon.

4. Postponement of class schedule can be done with a delay period of 1 month. If the replacement schedule exceeds on 1 month the class will be considered forfeited.

5. The tutor has the right to change the course schedule and is obliged to provide a replacement schedule so that the number of meetings can still be met.

6. The changes of schedule can be made if there is an agreement between the tutor, students and Lister academic team.

7. If a student registers in either a group or a private class and cannot attend the agreed schedule without any information, the student is not allowed to request for a class replacement.

8. If the student who has registered is not present in the agreed schedule without any information, the tutor in charge is required to contact the student concerned and ask about the continuation of the class.

9. If after being contacted by the tutor and the academic team, students who do not attend the class as mentioned in the previous clause do not answer or do not respond at all, then the student is given 1 (one) month to be able to join the class again. However, if within one month the student does not provide any information or confirmation to Lister academic team, then Lister is entitled to decide the cancellation of the course unilaterally and the course is declared forfeited.

10. If the changes proposed by the tutor with the limits of time exceeding three weeks and without of schedule replacement then Lister’s Academic team will provide substitute tutor for the corresponding class group.

 

B. Private Class.

1.Session cancellation upon the schedule that has been agreed by the student and the tutor must be made at least 1 (one) day before. This replacement can be in the form of changing the day and hour of the meeting.      

2. If a session is canceled for less than 1 (one) day, then the session that cannot be followed will be declared forfeited (no replacement).      

3. Replacement of class schedule session can only be done 3 times in 1 month.      

4. Changes in the schedule (schedule replacement) concerned can only be done with a maximum period of one month after the delay.

5. The changes of schedule can be made if there is an agreement between the tutor, students and Lister Academic Team.

6. If the student registered is not present in the agreed schedule without any information, the tutor in charge is required to contact the student concerned and ask the reason for the absence.       

7. In clause (f), if after being contacted by the tutor, student who did not attend the lesson without this information did not answer or did not respond at all, then the student is given 1 (one) month to be able to join the class again. However, if within the period of one month the student does not provide any information or confirmation to Lister, then Lister is entitled to decide the cancellation of the course and the course is declared forfeited.      

9. If the changes proposed by the tutor with the limits of time exceeding three weeks and without any certainty of schedule replacement then Lister Academic Team will provide substitute tutor for the corresponding class group.

 

V. Duration of study:                  

1.The duration of learning is 90 minutes per session. (except for some program – listed on the table below)

2. If in one meeting there are problems caused by the tutor that cannot be resolved immediately and the class must be stopped, then the meeting is counted as 1 meeting on the condition that the tutor concerned replaces the remaining time.

3. If in a meeting there are problems caused by student who is member of the class, the class can continue and the student concerned can follow the learning on the relevant learning recording. If that happens in a private class, the tutor is still obliged to replace the lesson with the remaining duration.

4. Each class must be completed within the agreed duration (listed on the table below).

 

 VI. Change of Tutor and Class Transfer      

1. Lister Management has the right to replace the Tutor if violates the Company’s code of ethics or is deemed incompetent in doing the job.      

2. Lister Management can replace tutor, in case of complaints from students after official procedures have been carried out.

 

VII. Additional Information                  

All opinions, aspirations and input from both tutor and student that cause changes in this agreement must be conveyed to Lister Academic Management. 

 

REFUND

VII. Refund

A. Refund Requirements

1.Refunds can be claimed if the class has not started, if the class is in progress, a refund cannot be submitted. Funds that have been paid cannot be returned (forfeited)

2. Each refund will be subject to a class cancellation fee of 25% of the course fee

3. Cancellation of courses made at the request of students served by customer service

4. The cancellation applicant is (must) the student taking the class.

5. The applicant must include the reasons for requesting a refund to the Lister

B. Refund Procedure

1.The applicant fills in the cancellation form which consists of the reasons for making the refund and a statement of fee collection

2. The refund application process takes a maximum of 3 working operational days (Saturday, Sunday, holidays, and national leave not counted)

3. If the application is accepted, the refund process will be carried out after 7 working days (Saturday, Sunday, holidays, and national leave do not count) from the date of submission of the refund

4. The lister will inform you when the refund funds have been transferred

5. If until the 7th day of work operation, the refund funds have not yet been received in the applicant’s account, please contact our customer service.

CLASS TRANSFER

The transfer referred to in this point can be in the form of a change from Group to private class or vice versa and program transfer. The conditions for submitting this transfer are:

  1. The cost of a new course or program must not be lower than the previous class.
  2. Transfer submissions must be submitted by the student concerned.
  3. Applicant must accept and agree to the terms and procedures of the Lister.
  4. Each application for transfer which the previous class already started will be charged an administration fee, 100.000,-.

The following is the procedure for submitting a class transfer or program that has been running.

  1. TRANSFER PROCEDURES

1.1. Switching from Group class to Private class

This transfer is allowed by the following procedure:

  1. Student apply for transfer to the Academic Lister with the included reasons.
  2. Academic Lister will process and check the meeting that has been running, a maximum of 3 working days.
  3. If approved, the student must wait a maximum of 7 working days to get a new tutor.
  4. If you have received a new tutor in a private class, then the student status becomes a private class, and you must follow the existing rules.

1.2. Switching from Private class to Group class

  1. Student apply for transfer to Academic Lister with reasons included.
  2. The Lister will process and check the meeting that has been running, a maximum of 3 working days.
  3. If approved, the student must wait for the start of a new class group that will come. Group classes are only open once a month, every 10th.
  4. If you have got a new group class, then the student status becomes a student group, and must follow the existing rules.

1.3. Transfer of programs in private classes.

  1. Student apply for transfer to Academic Lister with reasons included.
  2. Academic Lister will process and check the meeting that has been running, a maximum of 3 working days.
  3. If approved, the student must wait a maximum of 7 working days to find a new tutor in the intended program.
  4. If there is a new tutor in the proposed program, the student must comply with the existing learning rules.

1.4. Transfer of programs in groups

  1. Student apply for transfer to Academic Lister with reasons included.
  2. Academic Lister will process and check the meeting that has been running, a maximum of 3 working days.
  3. If approved, the student must wait for the start of a new class group that will come. Group classes are only open once a month, every 10th.
  4. If you have got a new group in the proposed program, the student must comply with the existing learning rules.
  1. DIFFERENCE IN FINANCING

The difference in financing is the remaining cost of the program that has been previously taken (after deducting the number of meetings held) plus the charge fee (100.000,-) and the cost of the transfer destination program. The remaining fees to be paid will be submitted together with the approval from the academic.

  1. PAYMENT OF COURSES FEES

The second party (student) is required to pay the fees that have been previously submitted by the academic before the program or class begins.
